These Terms of Service ("Terms") govern your use of the Movie Minder platform and related services operated by 3XM Technologies, Inc. ("3XM," "we," "us," or "our"). By accessing or using Movie Minder, you agree to be bound by these Terms.

1. Description of Service

Movie Minder is a mobile engagement platform that enables theater chains to communicate with their audiences through SMS reminders, push notifications, email, calendar integrations, and interactive mobile experiences. The platform is provided to consumers through our theater chain partners under their respective brands.

2. Eligibility

You must be at least 13 years of age to use Movie Minder. If you are under 18, you represent that you have your parent or guardian's consent. By using Movie Minder, you represent and warrant that you meet these eligibility requirements.

3. User Accounts & Information

When you provide personal information through Movie Minder, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.

4. SMS & Communications Consent

By providing your mobile phone number and opting in to receive text messages, you expressly consent to receive automated SMS messages from Movie Minder and our theater chain partners. This includes movie reminders, ticket alerts, promotional offers, and transactional messages. You may opt out at any time by replying STOP. See our SMS & Messaging Policy for full details.

5. Acceptable Use

You agree not to:

• Use Movie Minder for any unlawful purpose or in violation of any applicable laws.
• Attempt to interfere with, disrupt, or compromise the integrity or security of the platform.
• Use automated scripts, bots, or other tools to access the platform without our express permission.
• Impersonate any person or entity or misrepresent your affiliation.
• Collect or harvest personal information of other users.

6. Intellectual Property

Movie Minder, including its design, features, content, and underlying technology, is owned by 3XM Technologies, Inc. and protected by copyright, trademark, and other intellectual property laws. "Movie Minder" is a trademark of 3XM Technologies, Inc.

7. Third-Party Services

Movie Minder may contain links to or integrations with third-party services, including ticketing platforms, calendar services, and payment processors. We are not responsible for the content, privacy practices, or terms of these third-party services.

8. Disclaimer of Warranties

Movie Minder is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, secure, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, 3XM Technologies, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Movie Minder. Our total liability shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless 3XM Technologies, Inc., its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising out of your use of Movie Minder or violation of these Terms.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with a revised "Last updated" date. Continued use constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved in the state or federal courts located in Orange County, California.
